Not all Delta-9 THC products are legal in the United States, but… our Delta-9 THC gummies are legal in the US.
We’ll explain–
Delta-9 THC is arguably the main reason why marijuana has been such a popular plant for so long (most people refer to to the cannabinoid, Delta-9-Tetrahydrocannabinol, as just “THC.”) THC is also why marijuana is a Schedule I drug under the federal Controlled Substances Act of 1970.
When a state legalizes/decriminalizes marijuana for recreational use or medical use, they’re legalizing products (flower, edibles, etc.) with high concentrations of Delta-9 THC.
However, Delta-9 THC products can be legal in the United States (in every state) if they meet this criteria:
- The Delta-9 derives from the hemp plant (and not the marijuana plant)
- And that hemp is in concentrations of less than 0.3% by dry weight
Those standards were established in the 2018 Farm Bill which removed hemp as a federally controlled substance and made way for the legal cannabis industry we have today with CBD and more.
All Kushy Dreams Delta-9 products meet that criteria and are considered federally compliant. This can be seen in our lab reports that we make available here.
Are there additional restrictions on hemp-derived cannabis products in your area? You’ll have to check local and state restrictions as they change regularly.
